Tuvuke ("the Platform," "we," "us," or "our") is a peer-to-peer crowdfunding and funding platform that connects entrepreneurs in developing countries with supporters worldwide. The Platform facilitates fundraising campaigns and provides community-based funding services.

Important: Tuvuke acts as an intermediary platform only. We do not guarantee the success of any campaign or the performance of any user on the Platform.

2.1 Funding Requirements

Campaigns must reach 100% of their funding goal to be considered successful. If a campaign fails to reach its full funding target within the specified timeframe:

• All contributed funds will be returned to supporters
• A 5% processing fee will be deducted from returned funds to cover platform operational costs
• The remaining 95% will be refunded to the original payment method within 7-14 business days
• No funds will be disbursed to the campaign creator

2.2 Successful Campaign Fees

For successfully funded campaigns, the following fees apply:

• Platform fee: 5% of total funds raised
• Payment processing fees: 3.4% + $0.30 per transaction
• Currency conversion fees (if applicable): 2.9%
• International transfer fees (if applicable): $15-25 depending on destination

2.3 Self-Funding Requirements

All campaign creators must contribute a self-funding amount (capped at a maximum of $40 USD) as a demonstration of commitment. This self-funding requirement:

• Must be completed before the campaign goes live
• Must never exceed $40 USD
• Is non-refundable regardless of campaign outcome
• Demonstrates the creator's commitment to their project
• Builds trust within the Tuvuke community

2.4 Campaign Completion and Disbursement

When a campaign is marked as completed, the campaign creator receives the total funded amount minus the self-funding amount they contributed (which is non-refundable) and applicable platform fees. Disbursement is processed to the creator's verified mobile money number within 1-3 business days.

3.1 Campaign Creators

• Must provide accurate and truthful information about their project and identity
• Must use funds solely for the stated purpose in their campaign
• Must make good faith efforts to complete their project as described
• Must provide regular updates to supporters throughout the project lifecycle
• Must support at least one peer campaign before creating their own
• Are legally responsible for any tax implications of received funds

3.2 Supporters

• Must be 18 years or older to use the Platform
• Must provide accurate payment information
• Acknowledge that contributions are given freely to support campaigns
• Understand that contributions are not expected to be repaid
• Agree to resolve disputes through Platform mediation first
• Must not engage in money laundering or fraudulent activities

4.1 Funding Considerations

• Project Outcomes: Projects may not achieve their intended outcomes due to various factors beyond Platform control
• Currency Risk: Exchange rate fluctuations may affect fund values
• Regulatory Risk: Changes in local laws may impact fund transfers or project completion
• Self-Funding: The self-funding contribution (max $40 USD) is non-refundable under all circumstances

4.2 Platform Limitations

Tuvuke does not and cannot:

• Guarantee the accuracy of campaign information
• Ensure project completion or success
• Control external factors affecting projects (economic conditions, natural disasters, etc.)
• Provide investment advice or recommendations
• Act as a licensed financial institution or bank

5.1 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Tuvuke's total liability to any user shall not exceed the platform fees paid by that user in the 12 months prior to the claim
• Tuvuke is not liable for indirect, incidental, special, consequential, or punitive damages
• Users participate at their own risk and Tuvuke disclaims all warranties, express or implied
• Tuvuke is not responsible for user-generated content or third-party actions
• Force majeure events (natural disasters, government actions, etc.) release Tuvuke from performance obligations

5.2 Indemnification

Users agree to indemnify and hold harmless Tuvuke, its officers, directors, employees, and agents from any claims, losses, damages, or expenses (including legal fees) arising from:

• User's violation of these Terms
• User's campaign or contribution activities
• User's breach of any law or regulation
• User's infringement of third-party rights
• User's negligent or willful misconduct

5.3 Anti-Money Laundering and Fraud Prevention

Tuvuke reserves the right to:

• Conduct identity verification and due diligence on all users
• Freeze or reverse transactions suspected of fraud or money laundering
• Report suspicious activities to relevant authorities
• Terminate accounts that violate anti-money laundering policies
• Cooperate with law enforcement investigations

6.1 Dispute Resolution Process

1. Direct Communication: Users must first attempt to resolve disputes directly
2. Platform Mediation: If direct resolution fails, Tuvuke will provide mediation services
3. Binding Arbitration: Unresolved disputes will be settled through binding arbitration
4. Class Action Waiver: Users waive the right to participate in class action lawsuits

6.2 Governing Law

These Terms are governed by the laws of [Jurisdiction], without regard to conflict of law principles. Any legal proceedings must be filed in the courts of [Jurisdiction].

6.3 Intellectual Property

All Platform content, trademarks, and intellectual property remain the property of Tuvuke or its licensors. Users grant Tuvuke a non-exclusive license to use their campaign content for Platform promotion and operation.

• Violation of these Terms
• Fraudulent or suspicious activity
• Non-payment of fees
• Repeated disputes or complaints
• Regulatory requirements

7.2 Data Retention

After account termination, Tuvuke will retain user data for legal and regulatory compliance purposes for up to 7 years, or as required by law. Users may request data deletion subject to legal and operational requirements.

8.1 Terms Updates

Tuvuke reserves the right to update these Terms at any time. Users will be notified of material changes and continued use constitutes acceptance of updated Terms.
